1. Introduction

Brainlyft Learn is an educational platform operated by Crea8labs Digital Ltd.

The Platform supports learners, parents, guardians, teachers, schools, educational institutions, tutors, and independent families through digital learning tools, assessments, analytics, progress tracking, and academic competitions.

Brainlyft Learn may be used either through a registered educational institution or independently by parents, guardians, or eligible learners.

By accessing or using the Platform, you agree to these Terms.


2. User Categories

Brainlyft Learn may be used by:

  • Learners
  • Parents and guardians
  • Independent families and homeschool learners
  • Teachers and tutors
  • School administrators
  • Educational institutions

Different features, permissions, and dashboards may be available depending on the user's role and account type.


3. Learners Under 18

Where a learner is under 18 years of age:

  • A parent, guardian, school, or other legally authorized adult must provide any consent required by applicable law.
  • Personal information shall be processed in accordance with applicable child privacy and data protection laws.
  • Brainlyft may implement additional safeguards for minors.

Parents, guardians, and schools are responsible for ensuring that they have lawful authority to register, manage, or supervise learner accounts.


4. Educational Services

Brainlyft Learn may provide:

  • Curriculum-aligned learning content
  • Assessments
  • Practice questions
  • Academic competitions
  • Progress reports
  • Performance analytics
  • Parent insights
  • School insights
  • AI-assisted learning guidance
  • Career and subject recommendations

Educational content is provided to support learning and academic development.

Brainlyft does not guarantee examination success, admission, scholarships, or specific academic outcomes.


5. Parent, Guardian and Independent Family Accounts

Parents and guardians may create accounts to manage one or more learner profiles, whether or not those learners are enrolled in a participating school.

Parents and guardians may:

  • Register and manage learner accounts.
  • Monitor learner progress.
  • Access reports and learning insights.
  • Receive recommendations based on learner performance.
  • Link or unlink learners to participating schools where applicable.

Parents and guardians are responsible for:

  • Maintaining account security.
  • Providing accurate information.
  • Ensuring that information submitted on behalf of learners is lawful and accurate.
  • Supervising the use of the Platform by learners under their care.

Where learners are not linked to a participating school, parents and guardians remain solely responsible for the educational decisions and supervision of their wards.


6. School Accounts

Schools and educational institutions may create institutional accounts.

Schools are responsible for:

  • Managing authorized users.
  • Maintaining accurate learner records.
  • Ensuring lawful collection and sharing of learner information.
  • Obtaining any permissions required from parents or guardians where applicable.
  • Managing school competitions, classes, and reporting features available through the Platform.

Schools may only access information relating to learners who are linked to their institution through Brainlyft.


7. Academic Competitions

Brainlyft may organize educational competitions for:

  • Individual learners
  • Parents and their wards
  • Schools
  • Classes
  • Educational groups

Competition rules may vary depending on the event.

Brainlyft reserves the right to:

  • Verify participation and results.
  • Investigate misconduct.
  • Adjust rankings where necessary.
  • Disqualify participants who violate competition rules.

8. Acceptable Use

Users must not:

  • Cheat during assessments or competitions.
  • Share restricted examination or assessment materials unlawfully.
  • Upload harmful, unlawful, or misleading content.
  • Attempt unauthorized access to accounts or systems.
  • Interfere with the operation or security of the Platform.
  • Create fake learner accounts or misrepresent relationships with learners.

Violations may result in suspension or termination of access.


9. Intellectual Property

All educational materials, software, branding, databases, question banks, analytics, reports, learning pathways, and related content remain the intellectual property of Brainlyft or its licensors.

No content may be copied, reproduced, distributed, modified, or commercially exploited without prior written permission.


10. Privacy and Child Data Protection

Brainlyft is committed to protecting learner information.

Personal information shall be processed in accordance with:

  • The Nigeria Data Protection Act, 2023.
  • Applicable child privacy obligations.
  • Brainlyft's Privacy Policy.
  • Other applicable laws and regulatory requirements.

Information may be processed for:

  • Educational delivery.
  • Progress tracking.
  • Performance analytics.
  • Reporting.
  • Customer support.
  • Platform security.
  • Service improvement.

Brainlyft implements reasonable technical and organizational measures to safeguard personal information.


11. Communications

Users may receive:

  • Learning reminders.
  • Academic updates.
  • Performance notifications.
  • Competition announcements.
  • Service notifications.
  • Platform updates.

Parents, guardians, and schools may receive reports and notifications relating to learner accounts they are authorized to manage.


12. Suspension and Termination

Brainlyft may suspend or terminate access where:

  • These Terms are violated.
  • Fraud or misuse is detected.
  • Security risks arise.
  • Educational integrity is compromised.
  • False or unauthorized learner information is submitted.

Suspension of one account does not automatically terminate access for other authorized users linked to the same learner, unless required for security or legal reasons.


13. Disclaimer

Brainlyft provides educational support tools designed to complement teaching and independent learning.

The Platform does not guarantee:

  • Examination success.
  • Admission to educational institutions.
  • Scholarships.
  • Specific academic performance.
  • Career outcomes.

Learner success depends on individual effort, study habits, instructional quality, parental support, and other external factors beyond Brainlyft's control.


14. Limitation of Liability

To the fullest extent permitted by applicable law, Brainlyft shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the Platform, including decisions made by parents, guardians, schools, or learners based on information provided through the Platform.


15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of Nigeria.
